2026 Family Fun Day Waiver

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. SEIU Local 721 (“Local 721”) is sponsoring a Family Fun Day (the “Event”), which will include food, games, face painting, inflatable/bounce-house activities, and other family recreational activities. Participation in the Event is voluntary.

I am signing this Agreement for myself and, if applicable, as the parent or legal guardian of the minor child or children identified below. References in this Agreement to “Participant” include me and each minor child listed below.

I understand that participation in the Event involves risks of injury and property damage. These risks may arise from, among other things, use of inflatable or bounce-house equipment; running, jumping, climbing, games and other physical activities; interaction or collisions with other participants; slips, trips and falls; uneven or slippery ground or other conditions at the park; weather conditions; food, including food allergies or sensitivities; face paint or other materials; and the acts or omissions of other participants, volunteers, vendors, contractors or Event personnel. I understand that these and other risks may result in injuries ranging from minor injuries to serious bodily injury or, in rare circumstances, death. Knowing these risks, I voluntarily choose for myself and/or the minor Participant(s) identified above to attend and participate in the Event and assume the risks associated with that participation.

To the fullest extent permitted by California law, I, for myself and on behalf of any minor Participant identified above, release and waive any claims against SEIU Local 721 and its officers, members, employees, and agents arising from or related to attendance at or participation in the Event, including claims for personal injury, death, or damage to or loss of property resulting from the ordinary negligence of any released party. This release includes claims reasonably related to the Event, the activities offered at the Event, and the Participant’s presence at or use of the Event site. This Agreement does not release liability for gross negligence, reckless or willful misconduct, or any other liability that cannot lawfully be released under California law.

I understand that Local 721 may use independent vendors or contractors to provide food, inflatable equipment, entertainment, face painting, games or other Event activities. I understand that participation in an activity operated by a vendor may be subject to additional rules, restrictions or waivers imposed by that vendor.

If I am signing for a minor Participant, I represent that I am the minor’s parent or legal guardian and have authority to enter into this Agreement on the minor’s behalf. I accept responsibility for supervising the minor Participant while attending the Event, except to the extent the minor is participating in an activity that is being supervised by Event personnel or a vendor. I agree to make sure the minor follows posted rules and reasonable instructions concerning Event activities and equipment.

If I or a minor Participant requires emergency medical attention and I am unable to provide consent at the time, I authorize Local 721 personnel to contact emergency medical services and to provide emergency responders with reasonably necessary information. I understand that Local 721 does not assume responsibility for the cost of medical care provided to a Participant.

I have carefully read this Agreement and understand that by signing it I am giving up certain legal rights, including the right to bring certain claims against Local 721 for injuries or damages resulting from ordinary negligence. I enter into this Agreement knowingly and voluntarily. If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
