Failure to provide financial information: The City has stated that there is $63-million general fund deficit and given an arbitrary figure to your bargaining unit’s obligation to that figure. But they have not supplied us with data to justify both figures.Throughout this negotiation, the City has stalled or refused to comply with our repeated information requests.
Bad-faith bargaining/ Regressive bargaining: On Aug. 25 the City gave a counter proposal with additional concessions. This is
not good faith bargaining and is regressive.
We will file a formal opposition to the CAO’s declaration of impasse and an unfair labor practice of bad faith bargaining by early next week. The ERB must hear those charges and decide whether to declare impasse or whether bargaining can continue. If negotiations move forward in impasse, here are some details on the process:
1. Mediation: An independent third party who helps both parties work toward settlement.
2. Fact finding: A neutral third party who hears the outstanding issues and makes specific
recommendations.
3. Final Steps: The city can only move to unilaterally implement their last, best, and final offer after these steps are exhausted and only with a majority vote of the city council.
